Terms and Conditions of Sale at True-Precision

1. General

  1. The following terms and conditions (hereinafter referred to as “the Terms”) apply to the sale and/or delivery of any service/product (hereinafter referred to as “the Goods” or “the Service”) from True-Precision (owned by Value Group ApS, Lyreskovvej 7, Bov, 6330 Padborg, Denmark) to private individuals in the United Kingdom (hereinafter referred to as “the Customer”).
  2. The Terms apply unless otherwise explicitly agreed in writing between the Customer and True-Precision, regardless of whether the agreement is made via the internet, e-shop, e-mail, fax, telephone, or otherwise.
  3. It is a condition of the Customer’s purchase that these Terms are accepted, and the Customer is encouraged to read the Terms carefully.

2. Order procedure

  1. When you place an order on our website, an order confirmation is automatically sent to your email. If the order is placed via phone, email, or other means, an order confirmation will be sent as soon as our staff has entered the order into our system.
  2. You are encouraged to print the order confirmation upon receipt, as it may be relevant for exchanges, exercising your right of withdrawal, or complaints.
  3. When the order is dispatched from our warehouse, an invoice will be sent to your email.

3. Prices and Payment

  1. All stated prices are exclusive of VAT unless otherwise specified and are in GBP. True-Precision strives to also show all prices inclusive of VAT.

  2. At True-Precision you can use the follow payment methods :
    • Credit Card:
      VISA, MasterCard, VISA Electron, Maestro.
    • Invoice payment
    • Pay with Klarna: Klarna Pay Now and Klarna Pay Later
    • Bank Transfer: Orders are shipped once payment is received. Bank details are on the invoice; include your order number as reference.

  3. True-Precision uses a payment gateway provided by MOLLIE. All card data is transmitted securely and encrypted to protect your information. If we are unable to deliver the full order, we may reduce your payment to match the new order total. However, we cannot increase the amount if you wish to add one or more items. When paying by card, the amount will only be charged once the goods have been dispatched.
  4. Late Payment
    Interest will be charged on late payments in accordance with applicable law

4. Delivery and Shipping Costs

  1. Delivery is only made to addresses in the United Kingdom, True-Precision does not deliver outside of Europe.
  2. Delivery times
    If you purchase verification or a calibration certificate, an additional 2 days will be added to the delivery time.

    • You can view the expected delivery time for each product on its respective product page. Delivery times depend on the warehouse from which the item is dispatched.

    • If you purchase verification or a calibration certificate, 2 additional days will be added to the delivery time.
      This estimate does not apply to pallet or freight shipments. Please contact our support team for an estimated delivery time for these.
      True-Precision is not responsible for any financial losses resulting from delayed delivery.
  3. Distributor and Delivery
    All orders are shipped via either PostDanmark or UPS directly from our warehouses in Denmark , the United Kingdom or Germany. Please contact us if you wish to know the supplier for a specific product
    • PostNord: Private parcels are sent to the nearest post office or parcel shop. Business parcels are sent to the company’s address.
    • DPD: All parcels are delivered directly to the delivery address.
      True-Precision is not liable for indirect or consequential losses caused by delayed delivery. This does not affect your statutory rights.

  4. Shipping Costs

    True-Precision offers free delivery to the nearest collection point for all shipments. No handling fees apply. However, for some products, you may choose delivery to a private address for a fee of £7 GB. The option for private delivery depends on the warehouse from which the item is dispatched. You can view the available delivery options for your product during checkout.

    All our shipments are sent as insured parcels.


5. Retention of Title and Risk

  1. All products and goods purchased from True-Precision remain the property of True-Precision until the point of delivery. This means that the risk of loss and/or damage rests with True-Precision until delivery. The point of delivery is considered to be when the goods are delivered to you.

    However, you assume the risk for return shipments, unless the loss occurs accidentally during the withdrawal period, until True-Precision receives the goods.


6. Right of Withdrawal

You have a 14-day right of withdrawal from the day you or a third party designated by you (excluding the carrier) takes physical possession of the goods. You must notify True-Precision within 14 days of receipt to exercise your right of withdrawal. You then have 14 days to physically return the package.

Note: Costs for calibration certificates and verifications are non-refundable, as these involve manual work.

  1. Return Costs
    The buyer is responsible for the shipping costs when returning a purchase. If the customer refuses delivery, fails to collect the package at the collection point, or provides an incorrect delivery address, the customer will be charged for the return shipping costs plus an administration fee of £47 gbp.
  2. Software
    For software purchased and delivered electronically or on media such as CD/DVD/USB, the right of withdrawal expires as soon as the license is used and/or the seal is broken.
  3. Condition, Packaging, and Packing of Returned Goods
    Condition of the Goods: Goods may be tested but must not be used to an extent that prevents resale. If the item cannot be resold at the same price, the buyer must cover the reduction in value via a reduced refund. See the Reduction in Value section.
  4. Original Packaging and Accessories:
    Goods must be securely packed in all original and undamaged packaging and returned with all included accessories and documents, including manuals, batteries, and chargers. Missing or damaged packaging, accessories, or documents may reduce the refund.
  5. Packing: Once the item is securely packed in its original packaging, it must be further packed to ensure that neither the packaging nor the product itself is damaged during shipping. We recommend using a cardboard box that matches the product size. If the item or its packaging is damaged due to improper packing, the buyer will be responsible for the reduction in value via a reduced refund. See the Reduction in Value section.
  6. Reduction in Value
    The reduction in value is determined based on an overall assessment by True-Precision’ product manager, who has the greatest knowledge of the goods’ value and resale potential. Each return is individually assessed based on the item’s condition and any deficiencies.

    The following examples of deficiencies are provided as indicative rates and depend on the overall assessment and the severity of the defect or damage:

    • Missing product manual: 25% of the purchase price will be deducted from the refund

    • Missing accessories: 25% of the purchase price will be deducted from the refund

    • Damaged packaging: 25% of the purchase price will be deducted from the refund

    • Missing packaging: 25% of the purchase price will be deducted from the refund

  7. Partial Withdrawal from a Purchase
    At True-Precision, you may return part of a purchase. For example, if you have bought two scales, it is possible to return just one of them. However, any shipping costs are non-refundable for this type of return.

    2. Place the item in its original packaging and pack it securely, including a copy of the invoice.
      Note: See the section above, “Condition, Packaging, and Packing of Returned Goods.” If packaging or accessories are missing, the product shows signs of use, or the item is improperly packed for shipping, the buyer will be responsible for the reduction in value through a reduced refund.

    4. True-Precision will receive the item for inspection. The total amount will then be refunded within 7 days to the account used for payment. In case of any reduction in value, the corresponding amount will be deducted from the refund, and you will be notified by email.

We recommend that you keep the postage receipt as proof that you have handed the package to the post office or carrier.


7. Warranty / Right to Make a Complaint

  1. The right to make a complaint is always conditional upon presenting the original invoice and providing the serial number of the scale. Photo documentation, to the extent possible, will also support and optimise the complaints process. The complaint period starts from the date the customer receives the product.
  2. Loss of Warranty / Right to Complain:
    The right to make a complaint only covers defects arising from original faults in the product. The following conditions are not covered by the warranty, unless otherwise provided by applicable consumer law:
    • Normal wear and wear parts, including:
      • Batteries (with limited lifespan)

      • Power supply

      • Load cell, unless the defect is identified and reported immediately upon receipt

    • Rust caused by environmental conditions or usage

    • Use of non-original spare parts

    • Incorrect installation, setup, or connection

    • Misuse, mishandling, or incorrect operation

    • Costs associated with dismantling, reassembly, and reconnection

    • Fire, accidents, or other external influences

    • Repairs or modifications carried out by anyone other than True-Precision

    • Lack of or insufficient service and maintenance

    • Alterations to the product’s original construction

    • Damaged or removed serial number

 

  1. Procedure
    1. Contact customer service to report your complaint – provide your order number, product, and description of the defect.

    2. If the item is found to be defective and you have submitted your complaint within the required time, we will rectify such defects within a reasonable period. If it is not possible, or we do not consider it appropriate to repair the item, we will instead provide a new, fault-free item after the return of the defective item. We will also reimburse any documented expenses related to the return. If neither repair nor replacement is possible, we will refund the purchase price, including return shipping costs. 
    3. For replacement or refund: Customer service will send you a prepaid return label with the return address, which you should attach to the package containing the defective product and send it back.
    4. Once the item has been received and inspected, we will send you a replacement product. For refunds, the amount will be credited to your account within 7 days.
  2. Notification of Defects Within a Reasonable Time

    If you wish to claim a defect, you must notify us within a reasonable time after discovering the defect. Otherwise, you will lose the right to claim the defect. Notification given within two months of discovering the defect is always considered timely.

    If you have not notified us of a defect within two years of receiving the item, you cannot later assert the claim, unless we have undertaken to guarantee the item for a longer period.


8. Confidentiality and Personal Data

  1. Personal data is stored in encrypted form and transmitted in encrypted form to and from the company.
  2. Website Analytics
    Log statistics are used on www.True-precision.co.uk. This means that a statistical system collects information that provides a statistical overview of how many visitors the website has had, where they come from, which parts of the website they leave, etc. At www.True-precision.co.uk, log statistics are used for the purpose of optimising the website and its functionalities. Furthermore, the information in the log statistics may be linked to customers and users who visit the website, if the user provides name, address, or other personal details in connection with a purchase on the website or when creating a user profile.

    Log statistics are also used for: personalising marketing towards the user and improving user-friendliness
  3. In order to enter into an agreement with us via the website, you must register with the following personal information: Name, Address, Telephone number, and E-mail address.

    The personal data are registered with True-precision.com and stored by Pwoerhosting.dk.
    We process your personal data for the purpose of being able to deliver the goods to you.
    When personal data is collected via our website, we ensure that it is always done with your explicit consent, so that you are informed exactly which data is collected and for what purpose.
    The following groups of employees have access to the registered information: Management, Sales and Marketing, Administration, and Accounting.

    Information is only shared with third parties when necessary for payment processing, delivery or legal obligations.

9. Liability and Limitation of Liability

  1. Limitation of Liability
    True-Precision shall not under any circumstances be held liable for indirect or consequential losses, including but not limited to loss of profits, loss of business, claims from third parties, and/or damage to data.
  2. Product Liability
    True-Precision is liable for product liability in accordance with the applicable product liability law. You are obliged to notify True-Precision in writing without undue delay if a product liability incident has occurred, or if there is a risk that such an incident may occur.
  3. Force Majeure

    If an extraordinary situation occurs that is beyond the control of true-precision.co.uk, and which under applicable law is considered force majeure, True-Precision obligations shall be suspended for the duration of that situation. In such an extraordinary situation, you may cancel any unfulfilled order with True-Precision if the situation lasts, or is expected to last, longer than 60 days. In such a case, your notice period for cancellation is 14 days.

    True-Precision cannot be held liable for obstacles beyond our control, such as production disruptions, lightning strikes, prolonged power outages, strikes, or other unforeseen events.


10.Manuals

  1. When you purchase from True-Precision, you accept that products may come with an English manual. If you have any questions regarding the use of a scale, you are always welcome to contact us. You are, of course, also welcome to contact us in advance to find out which manual is included.

11. Disputes

  1. Jurisdiction
    The courts of England and Wales shall have exclusive jurisdiction.

  2. Choice of Law
    These Terms are governed by the laws of England and Wales. Agreements concluded between True-Precision.co.uk and the Customer.
  3. Complaints
    A complaint regarding a product or service purchased from us can be submitted to https://www.citizensadvice.org.uk/consumer/  You can submit a complaint via the Citizensadvice helpline.

12.Validity / Effective Date

These terms and conditions come into effect on 14 May 2019.


For businesses as well as commercial organisations and public authorities in the United Kingdom

1. Applicability

  1.   2. These Terms apply unless otherwise expressly agreed in writing between the Customer and True-Precision.co.uk, regardless of whether the agreement was concluded via the Internet, e-shop, e-mail, fax, telephone, or by other means.
  3. Acceptance of these Terms is a condition for the Customer’s purchase, and the Customer is encouraged to read the Terms carefully.

Information, Conclusion of Agreement, etc.

  1. The agreement is primarily concluded through the Customer’s electronic order on True-Precision.co.uk
    In addition, a purchase agreement can also be concluded either in writing (including via e-mail) or verbally (including by telephone).
  2. A final agreement between the Customer and True-Precision.co.uk is considered concluded only when True-Precision.co.uk, after receiving the Customer’s order on its server, has sent a written order confirmation by e-mail containing the order number, name and address, payment method, delivery address, and an overview of the ordered products/services.
  3. Any offer of products/services, price information, etc., on True-Precision.co.uk’s website or in sales materials, catalogues, etc., is solely to be regarded as an invitation to make an offer and is therefore not binding on True-Precision.co.uk.
  4. 3. Content of the Agreement

True-Precision.co.uk reserves the right to change the terms and conditions of business at any time. The Customer is bound by the terms and conditions in effect on the date of the order. These terms and conditions apply to all agreements concluded between True-Precision.co.uk and the Customer as the sole terms and replace all other terms.


4. Right of Complaint / Warranty Claims

  1. The right to make a complaint is always conditional upon presenting the original invoice and providing the scale’s serial number. Photo documentation, to the extent possible, will also support and facilitate the complaint process. The complaint period begins from the time the Customer has received the product.
  2. The Customer is obliged to inspect the product/service immediately, and no later than the day after receiving the delivery, to check for any defects. In the case of a delivery damaged during transport, it must be refused or accepted with reservation by noting it on the terminal/shipping document. Transport damage refers to externally visible damage to the packaging.
  3. True-Precision.co.uk can only be held responsible for remedying original defects and deficiencies in accordance with the provisions of the Consumer Rights Act 2015. If the Customer identifies defects or deficiencies, they must immediately submit a written complaint to True-Precision.co.uk specifying the defect in question. Failure to submit a timely complaint will result in the loss of the right to claim the defect.
  4. The complaint period is in any case limited to 12 months from the date of delivery. After the expiration of this period, the Customer can no longer invoke the defect. For third-party products, the complaint period specified by the relevant subcontractor’s warranty terms applies. Replacement or repair does not start a new 12-month complaint period.
  5. Power supplies, batteries, and other wear parts are excluded from the general right of complaint, unless otherwise agreed in writing.
  6. True-Precision.co.uk’s liability for defects and deficiencies is always limited to, at True-Precision.co.uk’s discretion, either remedying the defect or providing a replacement within a reasonable time.
  7. True-Precision.co.uk is not liable for defects or deficiencies caused, among other things, by modifications made by the Customer, repairs carried out by anyone other than ETrue-Precision.co.uk or its authorized service partners.
  8. No additional warranty is provided by True-Precision.co.uk unless explicitly and in writing agreed. Any warranty or service obligations beyond what has been explicitly and in writing agreed with True-Precision.co.uk are therefore not the responsibility of True-Precision.co.uk, but lie with the respective manufacturer and its authorized service provider.
  9. Loss of the Right to Make a Complaint:

If it proves impossible or we do not consider it appropriate to repair the product, we will instead provide a new, defect-free product upon return of the faulty item. We will also reimburse any documented costs associated with the return. If neither repair nor replacement is possible, we will refund the purchase price, including any return costs.

    • For replacement or refund: Customer service will send you a prepaid shipping label with the return address, which you must attach to the package containing the defective product and send it back.
    • Once the returned item has been received and inspected, we will send you a new product in case of replacement. For refunds, the amount will be credited to your account within 7 days.

5.  Right of Withdrawal

  1. Businesses have a 7-day right of withdrawal from the day on which the business or a third party designated by the business (excluding the carrier) takes physical possession of the goods.
    Note: Costs for calibration certificates and verifications will NOT be refunded, as these involve manual work.
  2. Return costs
    The buyer is responsible for the shipping costs when returning a regretted purchase. If the customer refuses to accept delivery, fails to collect the package from the pick-up point, or has provided an incorrect delivery address, the customer will be charged the return shipping costs plus an administration fee of 6GBP.
  3. Condition of the item, packaging, and packing when returning
    • Item condition: The item may be tested but must not have been used to a degree that prevents it from being resold. If the item cannot be resold at the same price, the buyer must cover the depreciation by receiving a reduced refund. See the section on Depreciation.

    • Original packaging and accessories: The item must be carefully packed in all original and undamaged packaging and returned with all included accessories and documents, including manuals, batteries, and chargers. Missing or damaged packaging, accessories, or documents will result in a deduction from the refund to cover depreciation. See the section on Depreciation.

    • Packing: Once the item is safely packed in its original packaging, it should be further protected to prevent damage to the product or its packaging during shipping. It is recommended to use a cardboard box appropriate for the size of the product. If the item or its packaging is damaged due to insufficient packing, the buyer will be liable for the depreciation, reflected as a reduced refund. See the section on Depreciation.

  4. Depreciation
    The determination of depreciation is based on a comprehensive assessment by True-Precision.co.uks product managers, who have the greatest knowledge of the item’s value and resale potential. Each return is therefore evaluated individually, taking into account the condition of the item and any defects or missing components.

    The following examples of defects can be considered as indicative rates and depend on an overall assessment, as well as the severity and extent of the defect or damage:

    • Missing product manual: 25% of the purchase price will be deducted from the refund

    • Missing accessories: 25% of the purchase price will be deducted from the refund

    • Damaged packaging: 25% of the purchase price will be deducted from the refund

    • Missing packaging: 25% of the purchase price will be deducted from the refund

6. Liability for damages

  1. True-Precision.co.uk is not liable for delays or defects in the product/service. True-Precision disclaims any responsibility for consequential and/or indirect losses, including but not limited to operational loss, loss of profit, loss of earnings, data loss, and/or other indirect losses, as well as costs associated with reinstatement, updates, or similar, arising from defects in the sold product.
  2. True-Precision.co.uk’ product liability is limited to the liability set out under the  Consumer Protection Act 1987 (CPA 1987), and True-Precision disclaims any further liability for product damage on any other grounds. The customer is obliged, without undue delay, to notify True-Precision in writing if a product liability damage has occurred, or if there is a risk that such damage may occur.

7. Product Information

Section 1. True-Precision strives to provide accurate and correct information about the products. However, typographical errors may occur.

Section 2. The images on True-Precision are for illustrative purposes only and are not part of the contractual basis.


8.  Prices

All prices are quoted excluding VAT, unless otherwise explicitly stated.


9. Payment

  1. Payment Methods
    • Credit Card Payment
      It is possible to pay by credit card at True-Precision.co.uk We accept Credit card, VISA, MasterCard, VISA Electron, and Maestro.

    • Invoice Payment (for businesses)
      If you choose to pay by invoice, you will receive the invoice by email as soon as the order has been dispatched. The invoice is issued either directly by us or by our factoring partner Midt Factoring, who in these cases will also handle the collection of payment. If you receive an invoice from Midt Factoring, all payment-related questions should be directed to Midt Factoring. The email and the invoice will include payment instructions. The payment term is 14 days. Invoice payment incurs a handling fee of 2.3 GBP excluding VAT.
  2. For orders over 80 GBP (excluding VAT), True-Precision.co.uk reserves the right to assess the Customer’s creditworthiness and, based on this assessment, require full or partial prepayment of the amount before the order is dispatched.
    If the Customer has chosen to have the order delivered on credit, True-Precision will, after the agreement is concluded, contact the Customer with further information regarding prepayment.
  3. The Customer may not offset the purchase price with claims arising from other legal relationships, and the Customer may not exercise the right of retention or refuse payment due to delays, complaints, or counterclaims related to the specific delivery.
  4. In the event of late payment, interest will be charged in accordance with applicable law.


10. Delivery

  1. Delivery times
    • You can view the delivery time for each product on its individual product page. Delivery times depend on which warehouse the item is dispatched from.
      Items that are out of stock will be shipped as soon as possible.

      The delivery times stated by True-Precision are approximate and non-binding, unless a fixed delivery date has been explicitly agreed for the entire order or part of it.

    • If you purchase a verification or calibration certificate, 2 extra days will be added to the delivery time.
      This estimate does not apply to pallet or freight shipments. Please contact our support team for an estimated delivery time for these.

      True-Precision accepts no liability for financial losses caused by delayed delivery.

  2. Shipping costs
    We offer free delivery at True-Precision! There are also no handling fees.
    All our shipments are sent as insured parcels.

  6. If delivery cannot be completed due to the customer’s circumstances, the item will be held at the customer’s risk and expense.
    In this case, True-Precision is entitled to charge storage fees and related costs.
  7. In the event of a delay, the customer may only cancel the agreement if the delay exceeds three weeks.
    In such cases, the customer is only entitled to a refund of any payments already made and may not claim any other remedies for breach of contract due to the delay.

12.  Retention of title

  1. www.true-precision.co.uk retains ownership of the item until full payment for the purchased goods has been received.

    Until ownership has passed to the customer, the sold goods must be stored and maintained properly. Any damage beyond normal wear and tear must be compensated by the customer. The customer is also obliged to keep the sold goods insured against fire, theft, and water damage for their full value.

     

  2. The customer undertakes not to dispose of the sold goods in any way that could compromise www.true-precision.co.uk ’ security interest in the item, including but not limited to pledging, renting, or lending the goods, without True-Precision’ written consent.
